Matt Warshaw: making the new Bible of Surfing, in encyclopedia mode

The legacy of surfing is secure. Matt Warshaw, the surfer/writer who believed and published the famous "Encyclopedia of Surfing" is putting the finishing touches in the digital version of the book.

The project has been funded by the planetary surfing community - through Kickstarter - and promises to be the most complete collection of stories, facts, photos and videos of the history of surfing.

The digital Encyclopedia of Surfing involves tons of work, research and verification. Warshaw and Justin Housman are managing the entire information and building a solid website, in which surfers will have the opportunity to browse and learn more about past surfers, surfboards and contests.

The good side of the web version is the possibility of constant updates and corrections. Web surfers can easily search for thousands of written entries and media.

Wikipedia’s Founder Foresees Hollywood’s Downfall

Jimmy Wales – the American entrepreneur and co-founder of the online non-profit encyclopedia Wikipedia – delivered his message to Hollywood’s studios: “You’re doomed, it won’t be piracy that kills you, and nobody will care,” he said.

Wikipedia’s founder, speaking at the Internet Society’s INET convention in Geneva, predicted that Hollywood will most likely share the fate of Encyclopedia Britannica which shut down its print operation this year after selling only 3,000 copies in 2010.

“Hollywood will be destroyed and no one will notice,” Wales said.

But it won’t be Wikipedia or Encarta that will put an end to the moviemaking industry:

”Collaborative storytelling and filmmaking will do to Hollywood what Wikipedia did to Encyclopedia Britannica,” he said.

Underlining the rapid development of technology, the video and mastering editing software era that entered our lives, gaining huge success – especially in our youngest sectors of society, he brought up the fact that his own 12-year-old daughter is already adept at iMovie and won a local award for a short movie she made.

And just as Wikipedia proved that collaboration on the web is possible, the coming generation will find ways of entertaining themselves by collaborating online to create movies; and their movies will include impressive special effects, CGI, and even remote actors, Whales believes.

Although Hollywood’s studios may not take these predictions seriously, and even if they may sound a bit “futuristic”, you can never know. If that’s the case, Hollywood won’t even see the punch coming. It would be beautiful.

The White House Recommends CISPA Veto; CISPA Dissected By The EFF

In a Wednesday e-mail released by the Office of Management and Budget, the latter said that if CISPA reaches the president’s desk in its current form, “his senior advisors would recommend that he veto the bill.”

“Legislation should address core critical infrastructure vulnerabilities without sacrificing the fundamental values of privacy and civil liberties for our citizens, especially at a time our Nation is facing challenges to our economic well-being and national security,” the e-mail states.

“The Administration looks forward to continuing to engage with the Congress in a bipartisan, bicameral fashion to enact cybersecurity legislation to address these critical issues. However, for the reasons stated herein, if H.R. 3523 were presented to the President, his senior advisors would recommend that he veto the bill.”

OMB’s message highlights various reasons on why the office opposes the bill, including that the bill “significantly departs from longstanding efforts to treat the Internet and cyberspace as civilian spheres” and that it “also lacks sufficient limitations on the sharing of personally identifiable information between private entities and does not contain adequate oversight or accountability measures necessary to ensure that the data is used only for appropriate purposes.”

In response, the authors of the bill said that Tuesday’s revisions take into account “nearly every single one of the criticisms leveled by the Administration, particularly those regarding privacy and civil liberties of Americans.”

The bill is set for a vote before the House of Representatives on Friday.

In addition we find out from an EFF’s report that Rep. Rogers is convinced that the Cyber Intelligence Sharing and Protection Act is an information “sharing” bill. Sounds so innocent, but the truth is that the act itself is also a surveillance bill. Its definitions allow private companies to monitor network traffic and stored data (including private e-mails) and transfer this kind of data to the government or others with no oversight or legal accountability, bypassing established privacy laws.

In a press call, Rep. Rogers said that the bill “does not provide any authority for the government to monitor private networks or read private e mail,” but the truth is that CISPA allows private companies to use “cybersecurity systems” – a very ambiguous term in the bill – to “identify and obtain” information on any relevant cyber threat, and then send the communications (without de-identifying the data) to the government. So giving this kind of power strictly based on good faith would be an act of insanity.

Furthermore, the bill creates expansive legal immunity, making companies and the government largely unaccountable to users. It provides “good faith” immunity for using those “cybersecurity systems” to obtain information, for not using for personal purposes the obtained information, and for making any decisions based on the information they receive. Let’s give an example to better understand under what circumstances CISPA works its magic: let us say that a company finds out about a security flaw, fails to fix it, and users’ information is misused or stolen (better said leaked). Well, if that happens, the companies are not to be held liable as long as they acted “in good faith”. In addition, companies “acting in good faith” are also liability-free for engaging in potential countermeasures, even if they harm innocent parties.

That means that CISPA grants surveillance power to private entities “notwithstanding any other provision of law,” bypassing existing rights to sue under laws like the Wiretap Act, the Stored Communications Act, and the Computer Fraud and Abuse Act. In other words, if CISPA passes, companies will lose their legal right to protect their users’ privacy, such as federal or state privacy laws that keep companies from sharing sensitive personal information like health records and personal financial information.

Although there is a proposed amendment that allows people to file lawsuits against the federal government in case it violates some restrictions on the use of the obtained data, in practice this amendment is meaningless. First of all, the amendment only permits a lawsuit if it’s brought within two years of the date of the violation and not the date of the discovery of the violation. Yet CISPA exempts all data received by the government from the Freedom of Information Act (FOIA), and blocks disclosure to any non-federal entity without the consent of the sending entity – meaning that it’s likely that users won’t be aware of any violation of their privacy for years (probably never), and when they do it will be too late, due to the two years limitation.

Second of all, if an individual sues the government, the government could invoke privileges like the state secrets privilege. This kind of lawsuit – involving classified information or state secrets – is difficult, expensive, and time consuming.

Here’s an example:

EFF (The Electronic Frontier Foundation) has been involved for years in a lawsuit claiming Fourth Amendment and statutory violations rooting from the warrantlesswiretapping program ran by the National Security Agency.

By combining immunity exemptions with weak federal liability CISPA will allow spying on users who ultimately are unable to hold companies and the government accountable for their actions.

You can protest against CISPA by sending an e-mail to the Congress, and also use EFF’s Congressional Twitter handle detection tool to tweet the Congress.

Kopimism Enters U.S. Borders

Recognized as an official religion in Sweden, file-sharing’s Church of Kopimism has launched on US territory.

The church’s name comes from “Kopimi” (“copy me”) and holds CTRL+C and CTRL+V as sacred symbols. Branches of the church have taken over 18 countries, including the UK, the Netherlands, Russia, Israel, France and Canada.

Adepts of Kopimism believe that communication and sharing is a sacred act that needs to be respected. They also consider that monitoring and eavesdropping on people is not acceptable.

In the US, the original Church of Kopimism exists in the form of First United Church of Kopimism (http://kopimistsamfundet.us/) – a non-profit organization registered with the state of Illinois. To become a member, Kopimists must copy the church’s symbol (the Holy Kopimi-pyramid) which consists of a pyramid with the letter K inside of it. They can download the sign from the church’s server, rewrite it or send a copy to a friend.

The First United Church of Kopimism launched in January, after Christopher Carmean translated the original church constitution from Swedish to English, and established a US website.

In a blog post the church writes:

“We do not involve ourselves with politics. We are interested in multiplying data and through this multiplication, knowledge and culture. We are not interested in depriving one group of some subset of intellectual property for the benefit of another. Copying is not stealing. Remixing is not stealing.”

“Plagiarism and the unauthorised sale of others’ creative content is a completely different subject. Kopimism does not condone these acts. We advocate copying and sharing for religious, not financial, reasons.”

The organization held its first service in early February, celebrating the holy transfer of information by listing the link for a BitTorrent file that contained several Kopi-pyramid images and their users’ artwork.

Kelly Slater warns of heavy pollution in Bali

Kelly Slater has reported the "worst pollution" he has ever seen, during his stay in Bali, Indonesia. The 11-time world surfing champion is concerned about the effect of so much litter in the oceans.

"I've never been so alarmed by pollution situation as this trip to Bali/Indo. We need solutions and multi-industry backing", Slater wrote on his Tweeter account.

"If Bali doesn't #DoSomething serious about this pollution it'll be impossible to surf here in a few years. Worst I've ever seen," Kelly added.

The Floridian spends many weeks away from home and has the opportunity to check multiple waves, in many countries, for the last decades. The pollution in Bali is getting worse over the last years.

Contest To Promote Indie Artists Launched By The Pirate Bay

The Pirate Bay has become in the past few months one of the most hunted websites online (and I don’t mean by the copyright groups this time). While many consider the portal a group of pirates with nothing to do than downloading copyrighted material, The Pirate Bay is proving different by launching a contest in order to promote independent artists.

“As you might have seen we sometimes replace our front page logo with others. Sometimes we link to important political issues like internet censorship and sometimes it’s to some cool indie musicians we like,” reads their promo page.
“We would now like to improve this feature. We want you to send us an email and tell us what you have and where you would like it to be shown.”

By making use of their homepage, TPB is planning on promoting musicians, movie companies, comedians, and other artists. Dubbed The Promo Bay, the competition page is encouraging people around the world to send their submissions, by sending a logo of their website and its direct link. TPB will then link to the selected submission’s page and post their logo to the TPB’s homepage.

“It’s an idea that we’ll let you, our creative users, borrow our front page for a few days, in a few countries. There you can have your own logo which will point to your bandcamp, youtube channel or website,” TPB said earlier this week.

“We believe that there are so many undiscovered artists out there and that there is so much crap flooding the top charts. So this is your chance to be discovered!”

TPB also addressed a few cautionary words for those willing to submit logos and links:

“On your site, you must have your songs or movie or whatever available for download, streaming or such,” the rules read.

“Please try to sell cd’s, shirts or funny hats if you want to, but not only. This is not just about making you rich. Please offer easy access to your material. No “like us to be able to listen” on facebook. Don’t lead your visitors into a maze. Just offer a simple and easy play button for whatever you have.”

It is one of the many steps that will encourage more and more artists to accept digital distribution and other alternative methods to promote their work. According to Tech.li, TPB received about 5.000 entries.

About Megaupload’s Multi-Billion Dollar Project

Prior to its shutdown, Kim Dotcom’s company was getting ready to “take over” the US stock market with a multi-billion dollar IPO. Megaupload had a talk with some of the “Big Four” auditors and some of the world’s most important investment banks.

Prior to its shutdown, the company was guarded by a group of devoted lawyers that had a single purpose: to ensure the company’s legitimacy. In a talk with TorrentFreak Kim Dotcom said that his company was getting ready to enter the US stock market through one of the biggest tech IPOs of all times.

Before US authorities started their raid, Megaupload was negotiating with some of the world’s top accountancy firms “to become auditors and large international banks were interested in underwriting the public offering.” The company was also looking into becoming publicly listed via a reverse merger, where it would purchase a listed company.

Robert Lim – a corporate advisor from Hong Kong – was asked to help Kim Dotcom’s company with this goal, and he agreed to give detailed information to TorrentFreak on this matter.

“I started providing advice to Megaupload management on exploring and researching options on becoming publicly listed by IPO or back door listing and other fund-raising options in early 2011,” Lim says.

“I understand the management and some of the shareholders had been discussing and exploring these options even prior to this time.”
Planning an IPO is no piece of cake, and the whole process is taking a whole lot of time, but Dotcom’s company was dead serious.

“Megaupload management had discussion with a number of the ‘Big Four’ largest international professional accountancy firms, which handle the vast majority of audits for publicly traded companies. These Big Four firms were invited to be the auditor and to work together with management to build out a road map to prepare Megaupload for an IPO,” Lim continued.

“This included any management and corporate restructuring to enhance efficiency and management of the group, and to review and enhance internal controls and corporate governance processes in the company as needed. Basically, some of the essential key things private companies need to do to prepare for public listing.”

Furthermore, Megaupload was also trying to convince some of the world’s leading investment banks to assist with the IPO plan. Although TF could not make public the names of the banks after discussing with Kim, Lim confirms that they were very interested about the proposal.

“Most of the response was positive. As long as Megaupload provided the commitment and flexibility to follow the necessary road map recommended by the professional firms to prepare the company for an IPO, it should not have been a problem.”

“Despite the global economic downturn, the tech sector still seems to be providing the most successful IPOs. Therefore, underwriters said Megaupload had a good chance to be a very successful IPO, with an estimated valuation of at least a couple of billion US dollars,” Lim told TF.

Truth be told, Megaupload was growing at a fast rate and, without any doubt, it was a leader in its sector.

But another important part of Megaupload’s story, of what the company could have become, is what happened in early 2012 when US authorities decided to shut it down, arresting a handful of people connected to the former website. On this matter, Lim said:

“Objectively speaking, for the criminal case it brings up the question if there really was a so-called ‘Mega-Conspiracy’ among Megaupload management. It is clear Megaupload management was seriously exploring options for taking the company to public listing.”

“They also knew full well that it would require a lot of scrutiny, due diligence and review of the operations, financials and overall business model of Megaupload not only by the auditors / accountants, lawyers for regulatory filings and IPO underwriters, but also the various regulatory agencies which govern the stock exchanges and public markets.”

“This does not fit with the ‘Mega-Conspiracy’ concept that Megaupload management is accused of, including that they knowingly and secretly conspired to do and hide criminal activities in Megaupload,” Lim concluded.

It is true that such facts make us wonder whether the US government knew about Dotcom’s plans or not. However, Megaupload’s plans for the future are a testimony that the company truly believed in a transparent and legitimate business.

Marlon Lipke conquered the 2012 Protest Vendee Pro, in a close fought low scoring final against Vincent Duvignac, Joan Duru and Romain Cloitre. The decisive heat was surfed in shifting 4-5ft waves, in which wind conditions severely affected peaks.

"The left here is so much fun, I remember surfing it like 10 years ago when I was staying at Gregory Pastusiak’s house and this whole event I’ve been surfing it despite everyone sticking to the right", Marlon said. Watch the final highlights, here.

"I guess it was kind of a risk for me but luckily it paid off! The wind picked up again during the final and destroyed the waves, with very few offering a shoulder to work with, but I felt like when you put a lot of energy in and keep catching waves then eventually it pays off".

Lipke, who qualified and surfed on the World Championship Tour in 2009, rises back and takes an early lead on the ASP European rankings. The 28 year-old German based in Portugal has been remodelling his approach to surfing events and starts 2012 with a strong goal of building up on his result in Vendee.
